HOME 2013 Final Rule Amendments
for Certifying Income

In an effort to provide clarification on Federal requirements and State policies governing the HOME, LIHTC, and NSP programs, the Authority has consolidated the requirements of these programs for certifying income into the Determining Income Manual. 

HOME Program Update:  The 2013 HOME Final Rule has amended several sections of the regulations that affect the income certification process and the eligibility of students to receive HOME assistance.

Specific changes are as follows:

  • 92.203(a)(1)(i) and (b)(2) has been amended to now require that in all cases a minimum of two months of source documentation is examined when certifying income for all potential HOME beneficiaries. [
  • 92.203(d)(1) has been amended to clarify that when determining annual income of a household, the income of all persons in the household, including non-related individuals must be counted.  This does not amend existing exclusions in the regulations pertaining to minor children and live-in aids.
  • 2013 Final Rule excludes certain students from participating independently in the HOME program.  The HOME program adopts the Section 8 Housing Choice Voucher (HCV) program restrictions on student participation found at 24 CFR 5.612, which exclude any student that:
    1. Is enrolled in a higher education institution
    2. Is under age 24
    3. Is not a Veteran of the U.S. Military
    4. Is not married
    5. Does not have a dependent child(ren)
    6. Is not a person with disabilities
    7. Is not otherwise individually eligible, or has parents who, individually or jointly, are not eligible on the basis of income.
Excluded students are prohibited from receiving any type of HOME assistance, including renting HOME-assisted rental units, receiving HOME tenant-based rental assistance, or otherwise participating in the HOME program independent of their low or very low-income families.
